Vacating NS Judgments (criminal law judgments, hereditary health judgments, military justice)

Vacting NS judgments did not occur in an overall or uniform manner. In the view of the first Federal Ministry of Justice, Thomas Dehler, concerns of legal certainty necessitated case-by-case decisions. This served to delay the rehabilitation of victims of the NS regime of injustice. The judgments of the Volksgerichtshof (National Socialist People's Court) and the Standgerichte (court martials) were not vacated until the adoption of federal laws dated 28 May 1998 and 17 May 2002. Cases involving military treason were not vacated until September 2009. This project examines the reasons for this long-delayed move.
